User information is collected on this site by the means of cookies. When a unique or casual user accesses the web site, a session ID is stored in a cookie on the user’s PC. For users who sign-up as members the cookie generated does contact their personal information and does record their activity for the expressed purpose of improving the site and generally enhancing the user experience. The cookie may remain stored on the user’s hard drive until such time as the user manually removes the cookie. Any user information and tracking of activity is exclusively limited to the site. Sensitive user information, such as credit card information, related to the purchase of products or advertising is not stored on the Everything EHST website.
As the content of the web portal Everything EHST consist of third-party applications and is a curated set of links to resources located on other sites both government and private, this policy guarantee does not necessarily apply. All user data is accessible and editable by individual users including the ability to download and or delete all of their records. We do not reuse the IP address. Any information acquired by us is subject to the limitations set forth in the Information Practices Act of 1977 (Title 1.8 (commencing with Section 1798) of Part 4 of Division 3 of the Civil Code). Use an image that is not your likeness, or is not strictly-speaking a head-shot photo for your profile.
Create a false identity.
Misrepresent your identity (e.g. by using a pseudonym), your current or previous positions, qualifications or affiliations with a person or entity.
Create a Member profile for anyone other than yourself (a real person).
Use or attempt to use another's account.
Harass, abuse or harm another person.
Use, disclose or distribute any data obtained in violation of this policy.
Disclose information that you do not have the consent to disclose (such as confidential information of others [including your employer]).
Violate the intellectual property rights of others, including copyrights, patents, trademarks, trade secrets, or other proprietary rights. For example, do not copy or distribute (except through the available sharing functionality) the posts or other content of others without their permission, which they may give by posting under a Creative Commons license.
Post anything that contains software viruses, worms, or any other harmful code.
Manipulate identifiers in order to disguise the origin of any message or post transmitted through the Services.
Imply or state that you are affiliated with or endorsed by The Industrial Safety & Hazmat Training Group, LLC Community without our express consent.
Remove, cover or obscure any advertisement included on the Services.

Use a Service for tasks unrelated to the express role and goals of the environmental health, worker safety, emergency response, and hazmat transportation professions such as the solicitation for:

Advocacy of causes, e.g. political, social, religious, and so on.
Pharmaceutical products
Work from home, make money online, and lead generating opportunities
Gambling services or products
Multi-level marketing or affiliate marketing
List brokers or list rental services
Selling 'Likes' or followers for a social media platform

1.4 Passwords. Sharing or distributing your user name and password to others for access to the Services is prohibited and may result in termination of your account. The Industrial Safety & Hazmat Training Group, LLC provides free and full access to the site for each user who signs up as a user and follows its policies.
1.5 Changes. The Industrial Safety & Hazmat Training Group, LLC reserves the right, in its sole discretion, to change any or all of the provisions of this Agreement at any time with the change to be effective immediately. Members will be notified when that happens.
1.6 Changes to Services. The Industrial Safety & Hazmat Training Group, LLC is constantly changing, updating, and improving its Services so it reserves the right to change, limit, or discontinue any aspect, content, tool, or feature that is a part of the Services.
1.7 Restrictions, suspensions. The Industrial Safety & Hazmat Training Group, LLC reserves the right, in its sole discretion, to restrict the use of the Service as well as suspend or revoke your rights to use the Services based on its belief that your use of the Services violates that permitted by this Agreement or applicable law.
IF YOU DO NOT AGREE TO THE PROVISIONS OF THIS AGREEMENT OR ARE NOT SATISFIED WITH THE SERVICE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE YOUR USE OF THE SERVICES.
2. Rights in Service Content and the Service 2.1 Copyright. All trademarks appearing on the Services are the property of their respective owners. You agree that you do not acquire any ownership rights in any downloaded content.
2.2 Personal use. You may search, retrieve, display, download, and print content from the Services solely for your personal research and reference purposes only (either for the benefit of yourself or for the benefit of your employer). Personal use does not include the right to resell the documents, to create a product for sale, or to share them outside of your organization.

3. User Activities and Privacy of User Information on the Service
3.1 Lawful Uses. You will use the Services and any tools, content, material, or information found on the Services solely for lawful purposes. 3.2 Rights in submissions. You warrant that any material or information that you make available through the Services, including, for example, postings to forums and documents you may post to your work area, is solely your original work, or that you have all necessary rights to make the material or information of any other person or entity available on the Services. You will be solely responsible for the content of any material or information that you make available through the Services. You will also be liable for any damage resulting from your making any material or information available through the Services.
3.3 License. Except as set forth below, by making any material or information available through the Services, for example, in postings to chat areas and forums, you automatically grant to The Industrial Safety & Hazmat Training Group, LLC a worldwide, royalty-free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate, distribute and sublicense any such material or information (in whole or in part) and/or to incorporate it in other works regardless of form, media, or technology. By making any material or information available through the Services, you also grant to users other than yourself the right and license to access, view, store, or reproduce your material and information for that user's personal, internal use.
3.4 Review of submissions. The Industrial Safety & Hazmat Training Group, LLC has no obligation to, and does not and cannot, review every item of material or information that you and users other make available through the Services, and so is not responsible for any content of this material or information. However, The Industrial Safety & Hazmat Training Group, LLC reserves the right to delete, move, or edit any material or information that it deems, in its sole discretion, unacceptable, libelous, defamatory, obscene, pornographic, abusive, or otherwise in violation of any law or that infringes or violates any privacy or other rights of any person or entity. Further, The Industrial Safety & Hazmat Training Group, LLC reserves the right at all times to disclose any material or information as necessary to satisfy any law, regulation, or governmental request.

4. Fees and Payments; Account Management
4.1 Payment terms. If you become a paid subscriber of any of the Services, you will be bound by the payment terms set forth herein. Access to premium areas of the Services requires payment. If you subscribe, you must provide accurate, complete and updated subscriber information. You acknowledge that you will pay The Industrial Safety & Hazmat Training Group, LLC all such fees, charges, and applicable taxes for the Services where enrollment in the Services has been made using your credit card or other means, whether made by you personally or by someone else in your household or organization on your behalf. If you enroll in the Services using a credit card, you certify to The Industrial Safety & Hazmat Training Group, LLC that you are at least 18 years of age and that you are the cardholder of the credit card, or that you are expressly authorized by the cardholder to enroll in the Services. In any event, you expressly certify and represent that you are not under the age of 13.
4.2 Use of Service. You further acknowledge that your obligation to pay The Industrial Safety & Hazmat Training Group, LLC all such fees, charges, and applicable taxes for the Service does not depend on usage of the Service. Your obligation to pay for the Service begins on the date of your enrollment in the Service, not the date of your first use of the Service.
4.3 Cancellation. You may cancel your monthly or yearly account for the Service during the first 90 days of the subscription period without charge. You may cancel your account for the Service by calling the customer service number located in the customer service area of the Services. General notifying your credit card company or bank that you no longer wish to be a subscriber, will not serve as valid means of cancellation.
4.4 Prices, renewals. Basic membership is free. The price you pay for any Service, such as being listed as a premium Provider & Supplier, is stipulated at the time you enroll in such Service, and are valid for your initial subscription period. The Industrial Safety & Hazmat Training Group, LLC reserves the right to change the price after the initial period. Unless other arrangements have been made directly with The Industrial Safety & Hazmat Training Group, LLC, YEARLY SUBSCRIPTIONS TO THE SERVICE ARE ON A CONTINUOUS RENEWAL BASIS. This means your annual subscriptions, this means every year on your annual enrollment anniversary. Your credit charge or other form of payment will be automatically charged or debited unless you have notified The Industrial Safety & Hazmat Training Group, LLC in accordance with Section 4.3 hereof that you wish to cancel the Service. Your subscription renewal will be at the then current price charged for the Service. YOU MUST CANCEL PRIOR TO YOUR SUBSCRIPTION RENEWAL DATE TO AVOID CONTINUED CHARGES.
5. Disclaimer of Warranties & Limitation of Liability
5.1 Your risk. You expressly agree that use of the service is at your sole risk. The Industrial Safety & Hazmat Training Group, LLC does not warrant that the services will be uninterrupted or error free or that they will be free of viruses or other harmful components. Nor do they make any warranty as to the results that may be obtained from the use of the service, or as to the accuracy, reliability, completeness, or contents of any content, information, material, postings, or posting responses found on the service, any merchandise or services provided through the services, or any links to other sites or services made available on the services.
5.2 As is. The services, all tools, content, material, information, postings, or posting responses found on the service are provided on an "as is" basis without warranties of any kind, either express or implied, including, but not limited to, warranties of title or implied warranties of merchantability or fitness for a particular purpose.
5.3 Consequential damages. Under no circumstances, including, but not limited to, negligence, shall The Industrial Safety & Hazmat Training Group, LLC be liable for any indirect, incidental, special or consequential damages that result from the use of, or the inability to use, any content, information, material, postings, or posting responses on the service, or the service itself. You specifically acknowledge and agree that The Industrial Safety & Hazmat Training Group, LLC is not liable for any defamatory, offensive or illegal conduct of any user, including you. In no event shall the total liability of The Industrial Safety & Hazmat Training Group, LLC exceed the amount paid by you to The Industrial Safety & Hazmat Training Group, LLC during the twelve (12) months prior to any claim of injury or damage.
6. Indemnification
To the maximum extent permitted by applicable law, you will defend, indemnify and hold harmless The Industrial Safety & Hazmat Training Group, LLC from and against all claims, liability, and expenses, including attorneys' fees and legal fees and costs, arising out of your use of the Service or your breach of any provision of this Agreement. The Industrial Safety & Hazmat Training Group, LLC reserves the right, in its sole discretion and at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you. You will cooperate as fully as reasonably required in the defense of any claim.
7. Third Party Content, Third-Party Providers, Advertising and Links
The Services include a number of third party providers of content, technology and other features, including the opportunity for users of the Services to purchase goods or services from third parties ("Third Party Providers"). These are provided for your convenience and are not endorsements by The Industrial Safety & Hazmat Training Group, LLC. Neither The Industrial Safety & Hazmat Training Group, LLC nor such Third Party Providers make any warranty concerning content, technology, goods or services provided by such Third Party Providers. YOU AGREE THAT ANY RECOURSE FOR DISSATISFACTION OR PROBLEMS WITH THOSE GOODS OR SERVICES WILL BE SOUGHT FROM THE THIRD PARTY PROVIDERS DIRECTLY, NOT FROM THE INDUSTRIAL SAFETY & HAZMAT TRAINING GROUP, LLC.
8. Termination
The Industrial Safety & Hazmat Training Group, LLC may terminate this Agreement and your use of the Services, or discontinue the Services, at any time, in its sole discretion, in what it considers to be unacceptable, or in the event of any breach by you of this Agreement or violation of applicable law.
9. Governing Law
This Agreement and any disputes arising under it shall be governed exclusively by the laws of the United States of America and the State of California, without giving effect to their conflict of laws principles. You expressly consent to the exclusive forum, jurisdiction, and venue of the Courts of the State of California in any and all actions, disputes, or controversies relating to this Agreement.
10. Complaints Regarding Content
We respect the intellectual property rights of others. We require that information posted by Members be accurate and not in violation of the intellectual property rights or other rights of third parties. We provide a policy and process for complaints concerning content posted by our Members.

The Industrial Safety & Hazmat Training Group, LLC seeks to avoid any reason for complaint, but if you think you have reason to complain about us, we will endeavor to resolve the matter quickly for you. We will keep you informed of progress as we seek resolution of your complaint. The Industrial Safety & Hazmat Training Group, LLC takes complaints very seriously. This Complaints Policy and Procedures defines our approach to complaint handling and how we deliver the expectations to our users and customers.
Complaints covered by this Policy
A complaint is any expression of dissatisfaction about the provision of, or failure to provide basic quality of service(s) expected of The Industrial Safety & Hazmat Training Group, LLC or of any of its subsidiaries.
Complaints not covered by this Policy
Please note that this Complaints Policy does not cover:
a) Matters that have already been fully investigated and considered resolved through this complaints procedure, unless new evidence is available.
b) If we think that your complaint should be handled by another entity such as law enforcement in the case of a possible unlawful act, we will forward the complaint accordingly and inform you promptly in a final response why the complaint has been forwarded, giving you the other entity's contact details.
Handling Complaints
We will accept complaints made by any reasonable means. If a complaint is not in writing, we may ask for the details to be put in writing or we may write to you by letter or email setting out our understanding of the complaint. On receipt of a complaint:
1. We will write to you within 2 business days of receiving it to acknowledge the complaint and confirm that we are dealing with it.
2. We will investigate the complaint carefully, diligently and impartially. This will be done by a senior member of our staff who was not directly involved in the matter giving rise to your complain after which;
a) We will decide whether we think that the complaint is justified.
b) If in our view the complaint is justified, we will decide what remedial action is appropriate.
c) We will write to you as soon as possible with our decision and explain clearly our assessment of the complaint, our decision on it and whether we propose any remedial action. If we cannot send you a final response within 1(one) week of receiving the complaint, we will write to you to explain why and to let you know when we expect to be able to complete the review and give you our final response. If we uphold a complaint, we will consider whether others who have not complained to us nevertheless may have had cause to complain.
Investigating the Complaint
To help us to review your complaint, we ask you to be clear about what the complaint is, to supply as much evidence as you can and also to let us know what action you are looking for us to take.
Factors that may be relevant in our assessment of a complaint include all of the evidence available and the particular circumstances of the complaint similarities with other complaints received by us.
During our review of the complaint, we may need to get further information from you and/or from others. We may also need to get clarification of the information you have provided to us. If we ask you for further information or validation, please respond to us as soon as possible as we may be unable to continue to review the complaint in the meantime.
Confidentiality
We will keep the matter of your complaint confidential as far as possible but it may be necessary for us to contact third parties for information. We will endeavor to do this without identifying you if this is possible. You may advise us that you will not allow us to identify you as the complainant but in such circumstances it may be impossible for us to complete our review of your complaint.
Compensation
Financial compensation only applies in cases where payment(s) were involved and only to the extent payments were made.
